By accessing or using the Ayata Platform, you agree to comply with theseTerms. If you do not agree, please discontinue using the Platform.

All services and products offered through Ayata are facilitated by third-party providers. Ayata serves as a technology intermediary, connecting users to these services while disclaiming liability for their execution or outcomes.

By registering, accessing, or using Ayata, you acknowledge that:
• You have read and understood this Agreement.
• You accept all provisions outlined in these Terms.
• You are solely responsible for ensuring compliance with applicable laws in your jurisdiction.

2. Scope of Services

2.1 Investment Products

Ayata provides access to curated third-party investment opportunities:
• Oxi Fund: Low-risk fund focusing on stable digital markets.
• Krypton Fund: Medium-risk fund leveraging cryptocurrency trends.
• Heli Fund: High-risk, high-reward fund targeting early-stage digital projects.

Performance data is illustrative and does not guarantee future results.

2.2 Payment Solutions

• Multi-currency payment cards with crypto-fiat integration.
• Access to ATM withdrawals, cashback rewards, and international payments.

2.3 Private Banking Services

Third-party financial institutions provide users with private banking solutions, including savings and checking accounts, limitless cards, and tailored advisory.

2.4 Crypto-Fiat Wallets

• Users can store, transfer, and exchange fiat and over 1,000 cryptocurrencies.
• All wallet services are managed by licensed third-party providers.

2.5 Community Features

• Users can participate in Ayata’s referral and rank-based community program.
• Benefits include tiered rewards, exclusive perks, and community recognition.

3. Eligibility

3.1 Age and Legal Capacity

Users must be at least 18 years old or the age of majority in their jurisdiction and possess full legal capacity to enter into this Agreement.

3.2 Prohibited Jurisdictions

Access to Ayata is restricted in jurisdictions where its use or the services it facilitates are prohibited by law. Users are solely responsible for ensuring compliance with local laws.

3.3 Account Creation

Users must provide accurate, complete, and up-to-date information during registration. Ayata reserves the right to suspend or terminate accounts found to be fraudulent or in violation of these Terms.

4. Third-Party Services

4.1 Integration

Ayata integrates services provided by licensed third-party entities. These include:
• Investment management firms.
• Financial institutions and payment processors.
• Crypto wallet providers and exchange platforms.

4.2 Liability

Ayata is not liable for any actions, failures, or breaches by third-party providers. All disputes must be resolved directly with the respective provider.

4.3 Independent Agreements

Users may be required to accept additional terms from third-party providers. Ayata is not responsible for terms, obligations, or liabilities arising from such agreements.

5. Fees, Payments, and Taxes

5.1 Platform Fees

Fees for accessing Ayata’s premium features or services are disclosed transparently. Fees are non-refundable except as required by applicable law.

5.2 Accepted Payment Methods

Ayata accepts payments in fiat currencies and select cryptocurrencies, such as USDT. Users must ensure accurate transaction details. Ayata disclaims liability for errors or delays caused by payment providers.

5.3 Taxes

Users are solely responsible for reporting and paying applicable taxes on income, transactions, or investments facilitated through the Platform.

6. User Obligations

6.1 Compliance with Laws

Users must comply with all local, national, and international laws, including:
• Anti-Money Laundering (AML) regulations.
• Know Your Customer (KYC) requirements.
• Securities and financial disclosure regulations.

6.2 Prohibited Activities

Users may not:

• Interfere with the Platform’s functionality or security.
• Use the Platform to distribute unauthorized content or materials.

6.3 Account Responsibility

Users are responsible for safeguarding their login credentials and must immediately report any unauthorized account activity.

7. Community Program and Referral Rewards

7.1 Referral System

Ayata’s referral program rewards users for introducing others to the Platform. Rewards are calculated based on activity metrics defined by third-party providers.

7.2 Rank-Based Privileges

Users can progress through ranks (e.g., Seeker, Architect, Mastermind), gaining access to exclusive benefits. Ranks are determined by community contributions and referrals but do not guarantee financial gains.

7.3 Code of Conduct

Participants must represent Ayata ethically and accurately. Misleading claims about earnings, benefits, or services are prohibited.

8. Intellectual Property

8.1 Ayata’s Rights

All intellectual property, including software, trademarks, and content, is owned by Ayata or its licensors. Unauthorized use or reproduction is strictly prohibited.

8.2 User Content

By submitting content to Ayata, users grant the Platform a global, royalty-free license to use, modify, and distribute the content for operational and promotional purposes.

Ayata collects personal data for account management and service delivery in accordance with its Privacy Policy.

9.2 Third-Party Sharing

This Agreement is governed by the laws of Hong Kong, without regard to conflict of law principles.

All disputes arising from this Agreement will be resolved through arbitration under Hong Kong International Arbitration Centre (HKIAC) rules.
